DEFENDANT Notice is hereby given that on Thursday, February 18, 2010, at the hour of 9:00 o'clock A.M., I will offer for sale at Public Auction, at the Commissioners Hearing Room on the 5th floor of the Administration Building in Warren, Ohio, the following real estate, to wit:
Situated in the City of Niles, County of Trumbull and State of Ohio: and known as being part of Section 9 of original survey of Weathersfield Township and being a part of a parcel of land containing 6.31 acres now owned by Helen Gazse and Sandor Gazse and being more particularly described as follows:
Beginning at the South east corner of Lot No. 40 of St. Johns Addition to City of Niles, as recorded in Trumbull County Records of Plat Book 7, at Page 46; thence Southerly along the extension of west line of Lot No. 39 to South line of property of Helen Gazse and Sandor Gazse; said South line being the North line of lands now or formerly owned by the Dollar Savings Bank of Niles, Ohio; thence westerly along said South line 50 feet to a point; thence Northerly along the extension of the West line of Lot No. 40 to the Southwest corner of Lot No. 40; thence easterly along South line of Lot No. 40 a distance of 50 feet to place of beginning and containing within said bounds approximately .14 of an acre of land, be the same more or less, but subject to all legal highways.

And cannot sell for less than two thirds of said appraisement. (NOTE: an interior inspection of the premises was not conducted and the property is sold "as is")
Said premises to be sold as the property of, JOHN FLANIGAN, ET AL to satisfy a judgment in favor of FIRST CHOICE COMMUNITY CREDIT UNION, INC. on an order of sale issued from the Common Pleas Court of Trumbull County, Ohio and to me directed as Sheriff of said County.
Terms of Sale:- - CASH or CERTIFIED CHECK. Ten Percent (10%) Deposit on day of sale or 100% full purchase price if less than $3,000; Balance in Thirty (30) days from date of confirmation of sale and unless paid within thirty days shall bear interest at ten percent (10%) until paid. Bids will include real property taxes & assessments due and payable as determined by ORC Section 323.47 and shall be paid directly by successful purchaser to Trumbull County Treasurer within 30 days from confirmation of sale. Failure to comply with bid process will result in contempt charges & forfeiture of entire deposit plus any damages allowable by law.
