Notice is hereby given that on Thursday, February 18, 2010, at the hour of 9:00 o'clock A.M., I will offer for sale at Public Auction at the Commissioners Hearing Room in Warren, Ohio, the following real estate, to wit:

Situated in the Township of Southington, County of Trumbull and State of Ohio and known as being part of Section 26 of the original survey of said Township bounded and described as follows:
Beginning at a spike set in the center of the Newton Falls-Southington-Smith Road where said center line intersects the south line of Section 26; thence N. 9 degrees 23’ E. along the center lie of said road, a distance of 508.07 feet to a point, the place of beginning; thence continuing North 9 degrees 23’ E. along the center line of said road a distance of 91.35 feet to a point; thence S. 86 degrees 36’ E. a distance of 473.8 feet to an iron pin set in the west line of lands now or formerly owned by Wayne Mumma; thence S. 2 degrees 9’ W. a distance of 90.88 feet to an iron pin; thence N. 86 degrees 36’ W. a distance of 485.3 feet to a point in the center of said Newton Falls-Southington Smith Road, the place of beginning and containing within said boundaries about 1 acre of land, be the same more or less, but subject to all legal highways.

Said premises to be sold as the property of DAWNELL D. GERNENTZ, ET AL to satisfy a judgment in favor of NATIONAL CITY MORTGAGE CO. on an order of sale issued from the Common Pleas Court of Trumbull County, Ohio and to me directed as Sheriff of said County.
Terms of Sale:- - CASH or CERTIFIED CHECK. Ten Percent (10%) Deposit on day of sale or 100% full purchase price if less than $3,000; Balance in Thirty (30) days from date of confirmation of sale and unless paid within thirty days shall bear interest at ten percent (10%) until paid. Bids will include real property taxes & assessments due and payable as determined by ORC Section 323.47 and shall be paid directly by successful purchaser to Trumbull County Treasurer within 30 days from confirmation of sale. Failure to comply with bid process will result in contempt charges & forfeiture of entire deposit plus any damages allowable by law.
