Notice is hereby given that on Thursday, February 18, 2010, at the hour of 9:00 A.M., I will offer for sale at Public Auction at the Commissioners Hearing Room on the 5th floor of the Administration Building in Warren, Ohio, the following real estate, to wit:

Situated in the Township of Newton, County of Trumbull, and State of Ohio, being part of Section Number 11 in said township, and being part of the Connecticut Western Reserve, Township 3 North and Range 5 West, and being part of lands now owned by Andy Zelenak, as recorded in Trumbull County Records, Vol. 900 Page 514 and being more particularly described as follows:
Beginning at a point in the south line of Section 11, at the intersection of the centerline of South Canal Street Extension (C.H. 105-B) and aforesaid south line of Section 11;
Thence along the centerline of aforesaid South Canal Street Extension N. 38 degrees 49’ 46” E. for a distance of 1041.38 feet to a point on the north line of R. & B. McGeehen, as recorded in O.R. 943-258 of Trumbull County Records, and being the southeast corner of the parcel herein described;
Thence N. 87 degrees 13’ 57” W., passing over a 5/8” I.D. capped rebar pin set at 37.11 feet, a total distance of 2170.49 feet to a 5/8” I.D. capped rebar pin set on the easterly line of lands now or formerly owned by Conrail;
Thence along the easterly line of Conrail along a curve to the right, a chord bearing of N. 36 degrees 19' 00" E., having a chord distance of 1017.33 feet and a radius of 3060.56 feet to a ¾" rebar pin found on the south line of D. Hanson, as recorded on O.R. 166 160 of Trumbull County Records;
Thence along the south line of aforesaid lands of D. Hanson, S. 87 degrees 21' 04" E., for a distance of 1715.07 feet to a 5/8" I.D. capped rebar pin set;
Thence S. 38 degrees 49’ 46” W. for a distance of 525.00 feet to a 5/8” I.D. capped rebar pin set;
Thence S. 87 degrees 21' 04" E. passing over a 5/8" I.D. Capped pin set at 476.80 feet, for a total distance of 513.97 feet to a point in the centerline of aforesaid South Canal Street Extension;
Thence S. 38 degrees 49’ 46” W. along the centerline of aforesaid South Canal Street Extension, for a distance of 529.55 feet to the true place of beginning of the parcel herein described and containing 38.5653 acres of land, inclusive of 0.3647 acres of land in said road right of way, as surveyed by Todd L. Blazsek, P.S. in October of 2003.

Thence along the south line of aforesaid lands of D. Hanson, S. 87 degrees 21’ 04” E. for a distance of 513.97 feet to a point in the centerline of aforesaid South Canal Street Extension;
Thence S. 38 degrees 49’ 46” W. for a distance of 525.00 feet to a point in the centerline of aforesaid South Canal Street Extension, to the true place of beginning of the parcel herein described and containing 5.000 acres of land, inclusive 0.3616 acres of land in said road right of way, as surveyed by Todd L. Blazsek, P.S. in October of 2003.

And cannot sell for less than two thirds of said appraisement. (NOTE: an interior inspection of the premises was not conducted and the property is sold “as is”)
Said premises to be sold as the property of ROBERT MILLER, ET AL to satisfy a judgment in favor of LASALLE BANK NATIONAL ASSOCIATION, AS TRUSTEE UNDER THE TRUST AGREEMENT FOR THE STRUCTURED ASSET INVESTMENT LOAN TRUST SERIES 2004-3 on an order of sale issued from the Common Pleas Court of Trumbull County, Ohio and to me directed as Sheriff of said County.
Terms of Sale:- - CASH or CERTIFIED CHECK. Ten Percent (10%) Deposit on day of sale or 100% full purchase price if less than $3,000; Balance in Thirty (30) days from date of confirmation of sale and unless paid within thirty days shall bear interest at ten percent (10%) until paid. Bids will include real property taxes & assessments due and payable as determined by ORC Section 323.47 and shall be paid directly by successful purchaser to Trumbull County Treasurer within 30 days from confirmation of sale. Failure to comply with bid process will result in contempt charges & forfeiture of entire deposit plus any damages allowable by law.
